Raffle Guidelines

In California, nonprofit organizations conducting raffles must adhere to specific regulations

under California Penal Code Section 320.5. Below are the key rules:

1. Distribution of Proceeds: At least 90% of the gross receipts from the raffle must go to beneficial or charitable purposes within California. A maximum of 10% of the funds can be allocated to cover expenses or prizes.

2. Ticket Sales: Raffle tickets can only be sold to individuals who are at least 18 years old.

Tickets must be sold within the state of California—online or out-of-state sales are

not permitted. Paper tickets are required for raffle entries; digital or online tickets are not allowed. All tickets must be sold in-person. Each paper ticket must contain: The name of the nonprofit organization conducting the raffle. The date and location of the raffle drawing.

The price of the ticket. A unique identification number to distinguish it from other tickets.

A statement indicating that 90% of proceeds will go to charitable purposes, as

required by law.

3. Prizes: There are no restrictions on the types of prizes that can be awarded in the raffle. Cash prizes are allowed, as long as the 90/10 rule is maintained.

4. Eligible Organizations: Only qualified nonprofit organizations (such as those with tax-exempt status under IRS Section 501(c)) are permitted to hold raffles. The nonprofit must have been in existence for at least one year before conducting a raffle.

5. Registration and Reporting: Nonprofits are required to register annually with the California Attorney General’s Registry of Charitable Trusts before conducting any raffle. Registration comes with a $20 fee. After the raffle, organizations must submit a Raffle Report, detailing the gross receipts, expenses, and distribution of funds.

6. Recordkeeping Requirements: Nonprofits must maintain accurate and detailed records for at least one year after the raffle. These records should include: Ticket sales records: Total number of tickets sold, unique ticket numbers, and

amounts collected. Gross receipts and expenses: A detailed account of all money raised, and costs incurred. Distribution of proceeds: Clear documentation showing that at least 90% of proceeds were used for charitable purposes. Prize information: A record of all prizes awarded, their value, and the recipients. Bank records: Financial records showing deposits and withdrawals related to the raffle. Records can be kept in paper or digital form but must be securely stored and available for review if requested.

Failure to comply with these rules may result in fines or the loss of nonprofit status.

Nonprofits should also ensure they stay up to date on any changes to state regulations.
